The Surfside Beach Pier opened in 2024 after the former pier was destroyed by Hurricane Matthew in 2016.

Surfside Beach leaders approved a resolution earlier this month to allow mobile kiosks on the town鈥檚 pier to sell alcohol.

That may not happen.

The South Carolina Department of Revenue says these kiosks would not be able to obtain a license to sell alcohol.

Pier committee chairman Dusty McCracken told the town council that his committee had approved five kiosks and two had expressed a desire to sell alcohol.

Public works director and pier manager John Adair said FEMA requires that any kiosks on the pier must be mobile聽and moved off the pier each night. That鈥檚 where the problem arises for the alcohol sales.

According to SCDOR spokesperson Tim Smith, 鈥淧otential licensees looking to acquire an Off-Premises Beer and Wine Permit to sell beer and wine on a fishing pier would need to adhere to the same regulations as a licensee obtaining a permit for any other location.聽

鈥淥ne of those regulations is that the kiosk would have to be located in a permanent location with a permanent address. The SCDOR would not issue a license to a mobile kiosk that did not have a permanent location and address.鈥

The two restaurants on the pier slated to open this spring, The Surf Diner and The Whistling Duck, would be allowed to sell alcohol because of their permanent situation.

Mayor Robert Krouse said if it鈥檚 unlawful, they won鈥檛 be able to get the licenses.

鈥淪imple as that,鈥 he said.

Council member LaVerne Kreklau said he did not vote for the resolution.

鈥淚 didn鈥檛 think it was a good idea in the first place,鈥 he said.
